§ 1 PRELIMINARY PROVISIONS
1.
The internet shop Mydeershop.com is run by MIWO CONSTRUCTION Michał Wojtczak entered in the Central Registration and
Information on Business Activity conducted by the Minister of Economy, REGON no 220857434, NIP no 9591352438
2.
These regulations constitute the rules for conclusion of distance sales agreements concluded
through the Store.
§2 DEFINITIONS
1.
Consumer
– A user who is a natural person making a legal transaction with the Entrepreneur within Mydeershop.com which is not directly connected with his/her business or professional activity
2.
Entrepreneur
– MIWO CONSTRUCTION Michał Wojtczak, with registered office at Horodniany 47,
16-001 Kleosin, entered in the Central Registration and Information on Business Activity
conducted by the Minister of Economy, REGON no. 220857434, NIP no. 9591352438
3.
User
– any entity making purchases through the Store.
4.
Shop
– Internet shop operated by the Entrepreneur at https://www.mydeershop.com

The Consumer may communicate with the Trader using the addresses and details
given in this paragraph.
§ 4 INTRODUCTORY INFORMATION
1.
The prices given in the Shop are given in Polish zloty and are gross prices (they include VAT).
2.
The final order price consists of the price for the goods and the delivery cost indicated on the
Shop’s website.
§ 5 PERFORMANCE OF THE SALES CONTRACT
1.
The User shall pay the Trader for the purchased goods within 14 days or at
upon delivery of the goods – depending on the method of payment chosen when
placing an order.
2.
The user may use, among others, the following forms of payment:
a.
transfer
b.
debit/credit card
c.
on delivery (cash on delivery)
3.
Detailed information on accepted payment methods can be found on the pages
Shop.
4.
The Goods shall be dispatched by the Entrepreneur within the period indicated in the description of the goods, in the manner
selected by the Consumer when placing the order.
§ 6 RIGHT OF WITHDRAWAL
1.
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
2.
The period for withdrawal shall expire after 14 days from the day on which the consumer acquires
possession of the goods or on which a third party other than the carrier and indicated by
the consumer has acquired possession of the goods.
3.
In order to exercise the right of withdrawal, the Consumer must inform the Operator of
of his decision to withdraw from the contract by an unequivocal statement using
the trader’s details given in these rules.
4.
The consumer may use the model withdrawal form set out at
at the end of these rules, but it is not obligatory.
5.
To meet the withdrawal deadline, it shall be sufficient for the consumer to send information
concerning the exercise of his right of withdrawal
before the expiry of the withdrawal period withdrawal period has expired.
6.
Effects of withdrawal:
a.
In the event of withdrawal the trader shall reimburse to the Consumer all
payments received from the Consumer, including the costs of delivery (
with the exception of
:
additional costs resulting from the method of delivery chosen by the Consumer
other than the cheapest normal delivery method offered by the Entrepreneur in the Shop),
immediately, and in any event not later than 14 days from the day on which the Trader
has been informed of the Consumer’s decision to exercise the right of withdrawal;
b.
the repayment shall be made by the Operator using the same means of payment as
were used by the Consumer in the original transaction, unless the Consumer has explicitly
agreed to another solution; in any event the Consumer shall not incur any fees
in connection with the reimbursement;
c.
The trader may withhold the reimbursement until he has received the goods or until
until he has received the goods back, whichever
whichever is the sooner;
d.
The Consumer should send back the goods to the address of the Entrepreneur given in these
Regulations immediately, and in any case not later than 14 days from the day on which
communicated the withdrawal from the contract to the Entrepreneur. The deadline shall be met if
Consumer sends back the goods before the expiry of the 14-day period;
e.
The consumer shall bear the direct costs of returning the item;
f.
The consumer shall only be liable for any diminished value of the goods resulting from the use of the goods
in a manner other than that which was necessary to establish the nature, characteristics and functioning of the thing.
7.
If the items cannot be returned in the usual way due to their nature
If an item cannot be returned by post due to its nature, information about this
and the costs of returning the item will be given in the description of the item in the Shop.
8.
The right of withdrawal from a distance contract shall not apply to the Consumer in relation to
to the contract:
a.
in which the object of the supply is a non-refabricated item
produced to the consumer’s specifications or intended to meet his individual needs;
§ 7 COMPLAINT AND WARRANTY
1.
The trader is obliged to deliver the item free from defects.
2.
In case of a defect in goods purchased from the Entrepreneur, the Consumer is entitled to
make a complaint based on the warranty regulated by the Civil Code.
3.
Complaints must be made in writing or electronically to the addresses given in these
the Entrepreneur’s address given in these regulations.
4.
It is recommended to include in the complaint, inter alia, a brief description of the defect, the date of its occurrence, data
consumer making the complaint and the consumer’s request in connection with the defective goods.
5.
The trader shall respond to the consumer’s complaint request within 14 days, and
if he fails to do so within this period it shall be deemed that the Consumer’s request is justified.
6.
Goods sent back within the complaint procedure should be sent to the address specified in § 3
Regulations.
7.
If a guarantee has been granted for a product, information about it and its content,
will be included in the product description in the Shop.
§ 8 out-of-court means of settling complaints and recovering claims
1.
The consumer has the possibility to use, among other things:
a.
mediation conducted by Provincial Inspectorates of Trade Inspection.
b.
with the assistance of permanent consumer arbitration courts operating at provincial
Inspectorates of Trade Inspection
§ 9 PERSONAL DATA
1.
When making purchases in the Shop, the User voluntarily provides his/her data which are necessary
to complete the order and will be processed for this purpose by the Entrepreneur.
2.
The user has the right to inspect personal data concerning him and to request that it be corrected.
3.
The administrator of the personal data is the Entrepreneur.
§ 10 FINAL PROVISIONS
1.
In matters not covered by these terms and conditions, the generally applicable
Polish law, in particular: the Consumer Rights Act of
30 May 2014, the Civil Code Act of 23 April 1964 and the Code of
Civil Procedure Code of 17 November 1964.
2.
A sales contract concluded on the basis of these terms and conditions relates to a specific order and
is concluded for the purpose of processing a single order. Each order requires a separate
acceptance of the regulations.
